1. Acceptance of terms
By accessing or using planmind.com.au (“the Site”) or any PlanMind tools (“the Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.
These Terms form a binding agreement between you and PlanMind ABN [INSERT ABN] (“PlanMind”, “we”, “us”, “our”).
2. Description of services
PlanMind provides a suite of AI-powered tools to help NDIS participants, families, and carers navigate the National Disability Insurance Scheme. Tools include: Plan Decoder, Goal Planner, Budget Calculator, Jargon Buster, NDIS Glossary, Support Letter Generator, and an NDIS Provider Directory.
Some features are free. Others require a one-time payment or subscription. The availability of features may change at any time with reasonable notice.
PlanMind is not affiliated with the NDIA, the NDIS, or the Australian Government. We are an independent information and technology service.
3. Eligibility
You must be at least 18 years of age, or have the consent of a parent or guardian, to use the Services. By using PlanMind you confirm that you meet this requirement.
4. AI disclaimer
PlanMind uses artificial intelligence (AI) models, including Anthropic Claude, to generate responses, summaries, goal statements, and support letters. AI can make mistakes. AI-generated output is provided for informational purposes only and does not constitute legal, financial, medical, or professional advice.
You should always review AI-generated content with a qualified Support Coordinator, Local Area Coordinator (LAC), or legal representative before submitting it to the NDIA or any third party. PlanMind accepts no liability for decisions made on the basis of AI output.
Anthropic retains AI inputs for up to 30 days for Trust & Safety purposes. PlanMind does not store your NDIS plan or health information on its servers. See our Privacy Policy for full details.
5. Payments & refunds
Paid features (such as the Support Letter Generator) are processed securely via Stripe. All prices are in Australian dollars (AUD) and include GST where applicable.
One-time purchases are non-refundable once the AI has generated your output, as the service has been delivered. If you experience a technical fault that prevented delivery, contact us at support@planmind.com.au within 7 days.
Subscription fees are billed in advance. You may cancel at any time; access continues until the end of the paid period. No partial refunds are provided for unused time.
6. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any regulation
- Attempt to reverse-engineer, scrape, or automate access to the Site
- Submit false, misleading, or fraudulent information
- Impersonate any person or entity
- Use the Services to harass, harm, or discriminate against others
- Circumvent any paywall, access control, or usage limit
We reserve the right to suspend or terminate access for any violation of these terms, with or without notice.
7. Intellectual property
All content, branding, software, and tools on PlanMind are owned by PlanMind or licensed to us. You may not reproduce, distribute, or create derivative works without our written permission.
Content you submit to the Services (e.g. plan excerpts, descriptions) remains yours. You grant PlanMind a limited licence to process it solely to deliver the requested output.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Limitation of liability
To the maximum extent permitted by Australian law, PlanMind's total liability to you for any claim arising out of or in connection with the Services is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
PlanMind is not liable for any indirect, incidental, special, or consequential loss, including loss of NDIS funding, loss of data, or loss of opportunity, even if we were advised of the possibility of such loss.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under the Australian Consumer Law.
10. Indemnity
You agree to indemnify and hold harmless PlanMind and its directors, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Services or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Services at any time for any reason, including breach of these Terms. You may stop using the Services at any time. Provisions that by their nature survive termination (including Sections 7, 9, and 10) remain in effect.
12. Changes to these terms
We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of New South Wales.
